These Terms of Service ("Terms") govern your access to and use of the services provided by Zone 6, LLC ("Zone6 Hosting," "we," "us," or "our"), including our website at zone6hosting.com, web hosting services, domain registration, email hosting, and related services (collectively, the "Services"). By purchasing or using our Services, you agree to be bound by these Terms.
You must be at least 18 years of age to purchase or use our Services. By agreeing to these Terms, you represent that you are of legal age to form a binding contract and are not barred from receiving services under applicable law.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account. We are not liable for any loss resulting from unauthorized use of your account.
Services are provided on a subscription basis, typically billed annually. Pricing, features, and billing cycles are as described at the time of purchase. We reserve the right to modify pricing with reasonable advance notice.
Subscriptions renew automatically at the end of each billing period unless cancelled prior to the renewal date. You are responsible for cancelling your subscription before renewal if you do not wish to continue service.
New hosting accounts are eligible for a full refund within 30 days of the initial purchase date. Domain registrations, SSL certificates, and add-on services are non-refundable. After 30 days, services are non-refundable.
Initiating a chargeback or payment dispute without first contacting us to resolve the issue may result in immediate account suspension and termination.
Your use of our Services is subject to our Acceptable Use Policy, which is incorporated into these Terms by reference. Violation of the Acceptable Use Policy may result in immediate suspension or termination of your account without refund.
Shared hosting plans are intended for normal website operation. We reserve the right to limit, suspend, or terminate accounts that use excessive server resources in a manner that adversely affects other customers or server stability.
We strive to provide 99.9% network uptime, excluding scheduled maintenance and circumstances beyond our control. Scheduled maintenance will be communicated in advance where possible. Uptime guarantees apply to network availability and do not cover issues arising from your website code, third-party applications, or actions on your account.
While we perform regular backups as a courtesy, you are solely responsible for maintaining your own backups of your website data. We do not guarantee backup availability or completeness and are not liable for data loss.
Domain registrations are subject to the policies of the applicable registrar and ICANN. Domain registration fees are non-refundable. You are responsible for providing accurate WHOIS registration information as required by ICANN.
You retain ownership of all content you upload to our servers. You grant us a limited license to host and transmit your content solely for the purpose of providing the Services. We retain all rights to our platform, trademarks, and proprietary technology.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ZONE6 HOSTING SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS INTERRUPTION, ARISING FROM YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE AMOUNT YOU PAID FOR SERVICES IN THE THREE (3) MONTHS PRECEDING THE CLAIM.
You agree to indemnify, defend, and hold harmless Zone 6, LLC and its officers, employees, and agents from any claims, liabilities, damages, or expenses arising from your use of the Services, your violation of these Terms, or your violation of any third-party rights.
Either party may terminate services at any time. We reserve the right to suspend or terminate your account immediately for violation of these Terms or our Acceptable Use Policy. Upon termination, your right to use the Services ceases immediately. You are responsible for retrieving your data prior to termination.
These Terms shall be governed by the laws of the State of Wyoming, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in Wyoming.
We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on our website. Your continued use of the Services after such changes constitutes acceptance of the revised Terms.
